Terms of Service
ThinkSwift Pty Ltd (stack, we, us, our) builds an AI-native business operating system for Australian professional services firms. These terms explain the rules that apply when you access or use stack.
These terms should be read with our Privacy Policy.

Section 01
Agreement to these terms
These Terms of Service apply when you visit stack.com.au, create a stack account, join a trial, subscribe to stack, or use any stack product.
By using stack, you agree to these terms. If you are using stack for a business or organisation, you confirm that you have authority to accept these terms for that business or organisation.
If you do not agree to these terms, you must not use stack.
Section 02
The service
stack is an AI-native business operating system for Australian professional services firms. It brings workspaces, contacts, communications, calendars, tasks, billing, and AI assistance into a single product.
Some features are included in the base product. Others may depend on your selected plan, enabled modules, connected integrations, usage limits, or beta availability.
Section 03
Accounts and workspaces
You are responsible for keeping your account details accurate and your sign-in credentials secure. Please tell us as soon as possible if you believe your account has been accessed without permission.
A workspace belongs to the business or organisation that created it, unless we have agreed otherwise in writing. Workspace owners and admins are responsible for managing users, access levels, connected integrations, and the data stored in the workspace.
Section 04
Trials, subscriptions, and payment
stack may offer free trials, founding rates, paid subscriptions, usage-based charges, module add-ons, telephony bundles, and custom implementation work. The details shown at signup or in your written order form apply to your account.
Unless stated otherwise, prices are in Australian dollars and include GST. Paid subscriptions renew automatically until cancelled. If a payment fails, we may retry the payment, contact you, limit access, or suspend the affected workspace until the account is brought up to date.
You can cancel a subscription at any time. Cancellation does not remove any amount already due, and access may continue until the end of the paid billing period unless we tell you otherwise.
Section 05
Acceptable use
You must not use stack to:
- break Australian law or any law that applies to you,
- send spam, unlawful marketing, or misleading communications,
- upload malware or attempt to compromise stack or another user,
- access data you are not authorised to access,
- interfere with another customer's use of stack,
- reverse engineer stack except where the law allows it,
- use stack or Penny to make decisions that require professional legal, medical, financial, or tax advice without appropriate human review.
We may suspend or limit access if we reasonably believe a workspace, user, or connected integration is creating a security, legal, or operational risk.
Section 06
AI features and integrations
Penny and other AI features are designed to help with business administration, communication, summaries, drafting, scheduling, and decision support. AI output may be incomplete or incorrect. You are responsible for reviewing important output before you rely on it or send it to someone else.
stack can connect to third-party services such as Google Workspace, Microsoft 365, Stripe, Xero, MYOB, Twilio, Resend, Supabase, and other tools. Your use of those services remains subject to their own terms and policies.
If you disconnect an integration, some features may stop working until you reconnect it or provide another supported data source.
Section 07
Customer data and privacy
You keep ownership of the business data, content, files, messages, contacts, calendar events, and other material you upload to or connect with stack.
You give us permission to host, process, transmit, back up, analyse, and display that data so we can provide, maintain, secure, and improve stack. This includes processing data through approved infrastructure and AI providers where required for the product to work.

Section 08
Security and availability
We take reasonable technical and organisational steps to protect stack and customer data. These include access controls, encrypted transport, monitored production access, and infrastructure controls provided by our hosting and data providers.
We work to keep stack available, but we do not guarantee that it will be uninterrupted or error-free. Maintenance, incidents, third-party outages, internet failures, and beta changes may affect access.
Section 09
Intellectual property
stack, Penny, the stack interface, product designs, software, documentation, branding, and related materials are owned by ThinkSwift Pty Ltd or our licensors.
We grant you a limited, non-exclusive, non-transferable right to use stack for your internal business purposes while your account is active and in good standing.
Feedback you give us may be used to improve stack. You are not required to provide feedback, but if you do, you allow us to use it without restriction or payment to you.
Section 10
Australian Consumer Law
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law.
If stack fails to meet a consumer guarantee that applies to you, the remedies available under the Australian Consumer Law may include having the problem fixed, cancelling the affected service, receiving a refund for the unused portion, or being compensated for reasonably foreseeable loss or damage. The exact remedy depends on the nature of the failure and the rights that apply in the circumstances.
Section 11
Liability
To the extent permitted by law, stack is not liable for indirect, consequential, special, or loss-of-profit damages, or for losses caused by third-party services, user error, unauthorised account use, or data supplied by you or your integrations.
Where the law allows us to limit our liability, our liability is limited to resupplying the affected service or paying the cost of having the affected service supplied again.
Section 12
Suspension and termination
You may stop using stack or cancel your subscription at any time. We may suspend or terminate access if you materially breach these terms, fail to pay amounts due, create a security risk, misuse the product, or use stack in a way that may expose us, other customers, or the public to harm.
After termination, we may retain account records and workspace data for as long as reasonably needed for legal, tax, security, backup, and dispute-resolution purposes.
Section 13
Changes to these terms
We may update these terms from time to time. If we make a material change, we will post the updated terms on the website and, where appropriate, notify account owners directly.
The effective date at the top of this page will always reflect the latest version.
Section 14
Governing law
These terms are governed by the laws of Victoria, Australia. The parties submit to the courts of Victoria and the Commonwealth courts of Australia that have jurisdiction in Victoria.
